Terms & Conditions

Our agreement with you:

When you decide to purchase our childcare services, we will provide a documentation pack. This will include an Application Form, terms and conditions, and fee details. Complete and return the Application Form to make an offer for our services. Upon receiving your application and registration fee, we will review it. If accepted, we will confirm in writing, marking the start of your contract. You can cancel the contract within 14 days. See clause 7 for details. Your contract with us includes these terms and any referenced documents. If specific statements influenced your decision to contract with us, ask for them in writing before completing your application to include them in your contract.

Service details

You are entering an agreement to purchase childcare services from us. We have years of experience, and our nurseries are independently inspected. Full details can be found at www.ofsted.gov.uk.

You are entering a contract with Maxxi Nurseries LTD. Our registered office is at 1 Suffolk Way, Sevenoaks, Kent, UK, TN13 1YL. Send all correspondence to this address or the one specified in your documentation pack.

Our subsidiary companies provide the childcare services. Details will be in your documentation pack. Services will begin on the date specified in your application form or as otherwise agreed in writing.

Our company does not offer babysitting services. You are not allowed to approach any staff member for babysitting. Any requests will be reported by staff and your child’s childcare service may be at risk. 

Our obligations to our clients

We will inform you promptly if your nursery application is successful and provide childcare at the agreed times, except when the nursery is closed. If we change the nursery’s hours, we will give you notice and work with you to adjust your child’s schedule. We will also try to accommodate any requests for additional or extended childcare hours. We will notify you promptly of any nursery closure days.
We do not allow parents to swop days if a day of attendance was missed due to illness/sickness or holidays. You can cancel your contract within 7 days of receiving our confirmation. To cancel, inform us in writing (by letter or email). Send your cancellation notice to your nursery, marked for the Nursery Manager, before the end of the 7-day period.

If you cancel within 7 days, we will refund all payments received, except if you requested childcare during this period. If you use our services during these 7 days, you must pay for them. Refunds will be processed using your original payment method without additional fees. After 7 days, you can end the contract with 1 term’s notice via email. 

We may end this contract immediately if you fail to pay fees, breach obligations without remedy, exhibit unacceptable behaviour, your child’s behaviour is unsafe, or we decide to close the nursery. We will provide as much notice as possible in such cases.

You may end the contract immediately if we breach our obligations and fail to fix it within a reasonable time or if we face insolvency.

Your obligation to us:

Ensure your application form is accurate, complete the Registration Form, and promptly update us with any changes.

Inform us of any Special Educational Needs and Disabilities (SEND) or medical needs. Complete a medicine consent form for any medication administration. Notify us immediately if your child has a contagious disease and keep them home to prevent spreading it to others.

Keep us updated on who will be collecting your child. Proof of identity is required for anyone not normally authorized. If we are not satisfied with their identity, we will not release your child. Inform us if your child is under a court order and provide a copy if requested. Notify us immediately if you cannot collect your child on time and give advance notice of any nursery absences.

Payments

Our fees are termly and will be provided before your child starts. Details are in the documentation pack. We may adjust fees and will notify you at least one term in advance. If you do not accept the revised fee, you may terminate the contract by giving one term’s notice via email to the nursery manager, ensuring you receive a confirmation.
No refunds are provided for absences due to illness, holidays, or bank holiday closures, as fees account for these closures.
All payments must be made via direct debit, childcare voucher, or tax-free childcare. Additional childcare sessions will be billed monthly in arrears, and your direct debit will be adjusted accordingly. Late payments will incur a 2% daily interest charge above the bank base rate and a £25.00 administration fee. A £25.00 fee applies for failed direct debits or other payment issues.
Reduced fees after your child’s birthday will apply from the first day of the next billing period.

Cancelling your childcare service contract

We may update these terms and conditions occasionally and will notify you of any changes in writing, including by email.
Only one child (oldest) may receive the NHS or sibling discount at a time. Children will not be released to anyone under 16 years old.

GDPR

Since May 25, 2018, the General Data Protection Regulation (GDPR) applies in the UK. We will comply with GDPR by processing personal data only to fulfil our contract and will:

– Collect, store, and process data lawfully and transparently.
– Collect data for specific, legitimate purposes.
– Keep data accurate and correct.
– Retain data only as long as necessary for our obligations.
– Implement security measures to protect data.
– Ensure third parties handling data follow GDPR.
– Use data solely for contract fulfillment and legal obligations, with no unauthorized processing or disclosure.
– Uphold your GDPR rights, as detailed in our privacy policy on our website.

General

We must report any suspected child neglect or abuse to authorities, with or without your consent. Inform us of any SEND or medical needs for your child to ensure we can provide proper care; failure to do so may affect your child’s place at the nursery.

In an emergency where permission from a parent or carer cannot be obtained, the nursery is authorized to consent to necessary emergency treatment.

If the nursery closes due to factors beyond our control, we are not required to provide alternative care. If the closure lasts more than 3 days (excluding regular closure days), we will credit you for the extra days.

For concerns or complaints, first speak with your child’s keyworker. If unresolved, contact the Nursery Manager. We prioritize customer satisfaction, and all concerns will be reviewed by the Nursery Director.

Our nurseries provide a range of toys and equipment, so your child should not bring their own. We are not responsible for any loss or damage to personal toys.

Occasionally, we take photographs of the children for promotional use. If you do not want your child included, please inform the Nursery Manager.

To maintain a nut-free environment, please avoid sending food or packaging with nuts to the nursery. Also, do not use creams or oils containing nut oil on your child, as this can affect others. For safety reasons, any information about allergies will be displayed on the wall in the child’s room so everybody is aware.
